Rule established

Back wages are not automatic upon reinstatement; Tribunal must consider whether worker was gainfully employed elsewhere during dispute period

Facts

  • Worker Shammi Bhan was wrongfully terminated from Uptron India
  • Tribunal ordered reinstatement with full back wages for the entire dispute period
  • Employer challenged: during the 4-year dispute, Shammi Bhan was gainfully employed elsewhere
  • Argued full back wages = unjust enrichment (worker earned from alternative employment AND claims full back wages)

Issue

  1. Whether full back wages should automatically follow an order of reinstatement, or whether intervening employment must be considered.

Held

  • Back wages are NOT automatic upon reinstatement
  • Tribunal must consider: (a) whether worker was gainfully employed elsewhere; (b) whether worker contributed to delay; (c) employer's capacity to pay
  • Partial back wages (50%) awarded because worker had been employed elsewhere for part of the period
  • Full back wages would constitute unjust enrichment

Ratio Decidendi

Reinstatement restores the employment relationship. Back wages compensate for lost income during wrongful termination. But if the worker earned income elsewhere during the dispute period, full back wages would give double recovery (alternative earnings + full original wages). Justice requires deducting alternative earnings or awarding partial back wages proportionate to actual loss.

How to use it in an exam

  • Part B/C: In any problem involving reinstatement + back wages, discuss Uptron India for the proposition that back wages are discretionary. Tribunal considers: (1) gainful employment elsewhere; (2) contribution to delay; (3) employer's capacity.
  • Key line: "Back wages are not automatic; Tribunal must consider intervening employment to avoid unjust enrichment."
